Chris Begeman and Rick Righi Launch Successful Defense in Toxic Tort Case
Chris Begeman and Rick Righi obtained summary judgment on behalf of a national home builder in a large, multi-party toxic tort case. Plaintiff homeowners claimed that TCE, emitted from an adjacent landfill, contaminated groundwater, causing stigma damages. Plaintiffs sued a variety of homebuilders, claiming that each had a duty to disclose the existence of the TCE. The original motion filed by Chris and Rick argued that the builders did not owe such a duty. The argument led to a dismissal of all subsequent purchasers and prevented an eventual class action by the remaining homeowners against any of the builders involved.
