Rick Righi, Beth Fitch, and Chris Begeman recovered $2 million on behalf of national homebuilder from an insurance carrier in garnishment and bad faith action. The bad faith action arose out of the homebuilder's claim against a design professional to recover settlements paid by homebuilder to numerous homeowners. Despite the design professional's proper and timely tender, the insurance carrier failed to provide a defense. Righi Fitch Law Group offered to resolve the claims against the design professional for the $1 million policy limit. When the design professional's insurance carrier refused, Righi Fitch Law Group negotiated a Damron agreement that included a judgment in the amount of $1.4 million-plus pre and post-judgment interest. Righi Fitch Law Group, on behalf of the homebuilder, then commenced a garnishment proceeding and civil action against the design professional's insurance carrier for breach of contract and bad faith. After limited discovery and prior to the garnishment hearing, the insurance carrier agreed to pay $2,000,000 in settlement.
